The Domestic Violence Act of 2005 in India defines domestic violence and establishes prosecution guidelines for reported cases. Section 3 of the Act specifies that domestic violence continues if the respondent:

  • Inflicts harm on the aggrieved’s health, life, limb, or physical or mental well-being, or engages in physical, sexual, economic, verbal, or emotional abuse.
  • Threatens the aggrieved or anyone related to her.
  • Harasses or harms the aggrieved to coerce her or any related person into meeting unlawful demands, such as dowry.
  • Causes any other form of physical or mental harm to the aggrieved.

Domestic violence represents a severe crime with multiple facets that can instill fear and confusion in victims. It is a widespread issue in India, though its distribution can vary across different communities. The term “domestic violence” indicates that the abuse occurs within a close relationship between the offender and the victim.
